Considered trader’s suggested commodity code 85176200. Heading 8517 Covers telephone sets, including smartphones and other telephones for cellular networks or for other wireless networks; other apparatus for the transmission or reception of voice, images or other data, including apparatus for communication in a wired or wireless network (such as a local or wide area network), other than transmission or reception apparatus of heading 8443, 8525, 8527 or 8528. The device subject to classification in this ruling does have wireless capability and is advertised as having the ability to ‘livestream’ its captured footage to a remote location (e.g. a remote PC, server or ‘the cloud’ etc ) in real time. However, the core function of the device is that of a digital cameral that records video. Without the aforementioned livestreaming capability the camera will still perform all of its essential functions and will store the footage locally on it’s built in storage. The essential character is therefore the camera and its recording facility rather than its wireless transmission and reception hardware.
