Ce chapitre comporte une longue liste d'exclusions et ne comprend pas : les bougies (position 3406), les articles de pyrotechnie (position 3604), les fils et tissus pour usage sportif classables dans la section XI, les coiffures de sport ou autres vetements de sport en textiles (section XI), les chaussures de sport (chapitre 64), les gants de sport en cuir (position 4203), les cravaches et fouets (position 6602), les yeux non montes pour poupees ou jouets de la position 9003, les articles de carnaval de la position 9505, ni les vehicules de sport autres que les bobsleighs et les luges. La position 9504 couvre les consoles et machines de jeux video, et les articles pour jeux de hasard ; les 'consoles et machines de jeux video' designent les appareils concus pour etre utilises avec un recepteur de television ou munis d'un ecran incorpore. Le chapitre couvre les poupees (position 9502), les autres jouets (position 9503 — y compris les modeles reduits, puzzles, instruments de musique jouets, armes jouets), les articles pour fetes foraines et jeux de table (position 9504), les articles de fetes (position 9505) et les articles pour sports, gymnastique et athletisme (position 9506).

La présente Section ne comprend pas : a) les ouvrages en matières plastiques des n°s 3924 ou 3926, les ouvrages en caoutchouc (n°s 4014 ou 4015) ou en caoutchouc vulcanisé non durci (n° 4017) ; b) les sacs, sachets et articles similaires du n° 4202 ; c) les ouvrages de sparterie ou de vannerie (n°s 4601 ou 4602) ; d) les revêtements muraux du n° 4814 ; e) les marchandises de la Section XI (matières textiles et ouvrages en ces matières) ; f) les marchandises de la Section XII (chaussures, coiffures, parapluies) ; g) les articles des Chapitres 82 ou 83 (ouvrages en métaux communs, outils, coutellerie) ; h) les articles de la Section XVI (machines et matériel électrique) ; ij) les articles de la Section XVII (matériel de transport) ; k) les articles de la Section XVIII (instruments, horlogerie, instruments de musique) ; l) les articles du Chapitre 95 (jouets, jeux, articles de sport, sauf indication contraire) ; m) les articles du Chapitre 97 (objets d'art, de collection ou d'antiquité). 2. Les références, dans les n°s 9401 à 9406, à des articles ou parties en une matière déterminée, couvrent également les articles ou parties constitués d'une combinaison de matières (par exemple, les meubles en bois et en métal). Toutefois, ces positions ne couvrent pas les marchandises relevant de positions plus spécifiques.

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 9503 00 and 9503 00 70 . Classification under CN code 9503 00 30 as an ‘electric train, including tracks, signals and other accessories therefor’ is excluded because the ‘set’ also contains other toys of wood and plastics, such as traffic signs, cars, human figures, animals, trees, etc., which are toys in their own merit. Those toys are not directly connected with the electric train and the tracks like a train station, a railway crossing or a railway bridge would be and are consequently not considered as accessories to an electric train (see also the Harmonized System Explanatory Note (HSEN) to heading 9503 , (D) (iv)). The ‘set’ of toys consists of different types of articles, designed for the amusement of children or adults, put up in the same packing for retail sale (see also the HSEN to chapter 95, General, and the Explanatory notes to CN code 9503 00 70 ). Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 9503 and 9503 00 70 . The images printed on the edges of the mat and the colourful prints covered by the coating, as well as the ‘special pen’ that is used for ‘writing’ with water indicate that the articles are designed for the amusement of children (see also the Harmonized System Explanatory Notes to Chapter 95, General, first paragraph). The ‘special pen’ is not an accessory to the mat, because it serves the main function of the mat, i.e. ‘writing’ on the mat. It does not adapt the mat for a particular operation, nor does it increase its range of operations, or enable it to perform a particular service connected with the main function of the mat. Although the mat can be ‘written’ on by means other than the pen, the pen is nevertheless the principal means to write on the mat. The ‘special pen’ can therefore not be considered a minor negligible article within the meaning of the third paragraph of the Explanatory Notes to the Combined Nomenclature (CNEN) to subheading 9503 00 70 . Consequently, the ‘special pen’ is an individual article of equal importance to the mat and both articles are forming a set. The articles can be considered as put up in a set within the meaning of the wording of subheading 9503 00 70 , because they are different types of articles. If presented separately, they would be classified under different subheadings of the CN (see also the CNEN to subheading 9503 00 70 , first paragraph). Classification under subheading 9503 00 99 is therefore excluded. Consequently, the article is to be classified under CN code 9503 00 70 as ‘other toys, put up in sets’. Classification is determined by General Rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 9503 00 and 9503 00 70. The form in which the product is presented and the value of the individual components clearly indicate that the set is to be used as a toy (see also the HS Explanatory Notes to heading 9503, penultimate paragraph). Classification as imitation jewellery under heading 7117 is excluded, as the product once assembled has the appearance and characteristics of a toy.
