1. Subject to Note 1(a) to Section XIV and except as provided in Note 2, all articles consisting wholly or partly: (a) of natural or cultured pearls or of precious or semi-precious stones (natural, synthetic or reconstructed), or (b) of precious metal or of metal clad with precious metal, are to be classified in this chapter. Additional Note 1: For the purposes of heading 7106, 7108 and 7110, the expression 'in semi-manufactured forms' applies to forms which have undergone working beyond that needed to produce bars, rods, profiles, wire, plates, sheets, strip and foil, but which, by reason of their form, are not classifiable as articles or parts thereof falling in heading 7113 to 7118. Additional Note 2: For the purposes of heading 7113, the term 'articles of jewellery' means small objects of personal adornment (gem-set rings, bracelets, necklaces, brooches, earrings, watch chains, fobs, pendants, tie pins, cufflinks, dress-studs, religious or other medals and insignia). This term does not include articles of goldsmiths' or silversmiths' wares (heading 7114).
For the purposes of this chapter, 'precious metals' means silver, gold and platinum. 'Platinum' includes iridium, osmium, palladium, rhodium and ruthenium. The term 'precious metal alloys' includes alloys containing one or more precious metals, provided the precious metal content by weight is at least 2% for platinum group metals or at least 2% for gold or silver alloys (specific thresholds apply). 'Precious stones' and 'semi-precious stones' are defined in the Explanatory Notes and include diamonds, rubies, sapphires, emeralds (precious), and all other gemstones (semi-precious). The chapter also covers 'rolled precious metal' (base metal clad with precious metal by soldering, welding, hot-rolling, etc., where the precious metal coating thickness is at least 5% of total weight). The chapter excludes dental amalgams, chemicals of heading 2843, and coins that are legal tender.

(B) Heading 7116 does not cover articles containing precious metal or metal clad with precious metal (other than as minor constituents). 3. This Section does not cover: (a) amalgams of precious metal, or colloidal precious metal (heading 2843); (b) sterile surgical suture materials, dental fillings or other goods of Chapter 30; (c) goods of Chapter 32 (for example, lustres); (d) supported catalysts (heading 3815).

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 11 to Chapter 71 and by the wording of CN codes 7117, 7117 19 and 7117 19 00 . The article is designed to be worn on the body or on clothes. It is considered a small object of personal adornment (see also Harmonized System Explanatory Notes (HSEN) to heading 7117, first paragraph). Classification under heading 8306 as ‘ornaments of base metal’ is excluded as the article is not of a kind designed essentially for decoration, in homes, offices, etc. (see also the HSEN to heading 8306, part (B), first paragraph). That heading covers only medallions other than those for personal adornment (see also the HSEN to heading 8306, part (B), third paragraph, (1)). Whereas the Common Customs Tariff annexed to Council Regulation (EEC) No 950/68 (2), as last amended by Council Regulation (EEC) No 3300/81 (3), lists imitation jewellery under heading No 7117 and surgical instruments under heading No 90.17 ; whereas for the classification of the abovementioned articles the aforesaid headings merit consideration; Whereas these articles do not require under normal conditions of use the intervention of a medical practioner to make a diagnosis, or to prevent or treat an illness, or to operate within the meaning of the first paragraph of the Explanatory Notes to heading 90.17 of the Customs Cooperation Council nomenclature ; whereas even during the period of the healing process when they also serve to prevent the pierced holes from closing up their main function is that of an object of personal adornment within the meaning of Note 10 (a) to Chapter 71; Whereas, therefore, these stud earrings fall within heading No 7117 ; whereas, being of base metal, they must be classified under subheading 7117 19 00; Whereas the measures provided for in this Regulation are in accordance with the opinion of the Committee on Common Customs Tariff Nomenclature, Documented CN 2026 code: 71171900.
