Entry Summary Declaration (ENS)
Safety-security declaration transmitted to customs authorities before goods arrive in the EU customs territory, under the ICS2 system.
Definition and legal framework
The Entry Summary Declaration (ENS) is a regulatory requirement under the Union Customs Code (UCC) for safety-security control of goods entering the EU. It must be filed before the physical arrival of goods with the customs office of first entry.
Filing deadlines by transport mode
- Containerised maritime: 24 hours before loading at the port of departure
- Bulk/break bulk maritime: 4 hours before arrival
- Long-haul air: at the latest at the time of departure (or 4 hours before arrival)
- Short-haul air: at the time of actual departure
- Road: 1 hour before arrival at the entry point
- Rail: 2 hours before arrival
ICS2 system
Since the deployment of ICS2 (Import Control System 2), ENS declarations are processed in a centralised European system. Deployment occurred in three phases:
- Phase 1 (March 2023): air carriers — minimum pre-loading data
- Phase 2 (March 2024): air freight forwarders, postal and express services — full data
- Phase 3 (2025-2026): extension to maritime, road, and rail
Required data
The ENS requires: consignor, consignee, 6-digit HS code, gross weight, number of packages, routing, container number. The objective is to enable pre-arrival risk analysis to target high-risk consignments.
Penalties
Failure to file or late filing exposes the operator to administrative penalties and may result in loading refusal (for air) or entry refusal of goods.
