Sous réserve de la Note 1 de la présente Section, de la Note 1 du Chapitre 84 et de la Note 1 du Chapitre 85, les parties de machines (à l'exclusion des parties des articles des n°s 8484, 8544, 8545, 8546 ou 8547) sont classées conformément aux règles suivantes : a) les parties consistant en articles compris dans l'une des positions des Chapitres 84 ou 85 (à l'exclusion des n°s 8409, 8431, 8448, 8466, 8473, 8487, 8503, 8522, 8529, 8538 et 8548) relèvent de ladite position ; b) les autres parties, reconnaissables comme étant exclusivement ou principalement destinées à une machine particulière ou à plusieurs machines d'une même position, sont classées dans la position afférente à cette ou ces machines ou, selon le cas, dans le n° 8409, 8431, 8448, 8466, 8473, 8503, 8522, 8529 ou 8538 ; toutefois, les parties également utilisables principalement avec les articles des n°s 8517 et 8525 à 8528 relèvent du n° 8517 ; c) les autres parties relèvent du n° 8409, 8431, 8448, 8466, 8473, 8503, 8522, 8529 ou 8538 selon le cas, ou à défaut du n° 8487 ou 8548. 3. Sauf dispositions contraires, les combinaisons de machines constituées de deux ou plusieurs machines formant un tout et les autres machines conçues pour remplir deux ou plusieurs fonctions complémentaires ou alternatives sont classées suivant la fonction principale qui caractérise l'ensemble. 4. Lorsqu'une machine ou une combinaison de machines est constituée d'éléments individuels (même séparés ou reliés entre eux par des conduites, des dispositifs de transmission, des câbles électriques ou autres dispositifs) destinés à concourir ensemble à une fonction bien définie couverte par l'une des positions des Chapitres 84 ou 85, l'ensemble est classé dans la position correspondant à cette fonction. 5. Au sens des présentes Notes, le terme « machine » s'entend de toute machine, tout mécanisme, tout appareil, tout dispositif, tout engin ou toute installation cité dans les positions des Chapitres 84 ou 85.

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, note 3 to Section XVI, note 5 (E) to Chapter 84 and by the wording of CN codes 8521 and 8521 90 00 . Given its objective characteristics, the apparatus is intended to work together with up to eight cameras for video-surveillance purposes. A machine which, for such purposes, records signals from cameras and can either send them to another IP address or reproduce them on a display or monitor, performs a specific function other than data processing within the meaning of note 5(E) to Chapter 84. (See also judgement of the Court of Justice of 17 March 2005, Ikegami Electronics, C-467/03, ECLI:EU:C:2005:182). Classification under heading 8471 as an automatic data-processing machine is consequently excluded. The apparatus is designed for the purpose of performing two or more complementary functions within the meaning of note 3 to Section XVI, namely transmission and reception of data of heading 8517 and video recording and reproducing of heading 8521 . Based on the objective characteristics of the apparatus, the principal function is that of video recording within a security and surveillance system. The transmission and reception of data is merely an ancillary function intended to improve the operation of the system in which the apparatus is incorporated. Classification under heading 8517 is therefore excluded. (See also judgement of the Court of Justice of 25 February 2016, G. E. Security, C-143/15, ECLI:EU:C:2016:115, paragraphs 55 to 57).
