Classification is determined by General Rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 1 to Chapter 23 and the wording of CN codes 0307, 0307 99 and 0307 99 80. The product is fit for human consumption. Therefore, classification under heading 2301 is excluded (see also the Harmonized System Explanatory Notes to heading 2301, point (1)). The product has retained the essential characteristics of the original material (mussel powder). Classification under heading 2309 as a preparation used in animal feeding is therefore excluded in accordance with Note 1 to Chapter 23.
