Category 5 - Telecommunications and 'Information Security'

Category 5 is divided into two parts. Part 1: telecommunications equipment (5A001), interception systems, network surveillance. Part 2: information security - encryption (5A002, symmetric key threshold > 56 bits), cryptographic software (5D002), TEMPEST technology (5A003). The Crypto Note (Note 3) exempts mass-market products (smartphones, Wi-Fi routers). This is the category with the highest authorized export volume by value in the EU (20% of total).

General Technology Note (GTN)

The export of 'technology' which is 'required' for the 'development', 'production' or 'use' of items controlled in Categories 0 to 9 is controlled according to the provisions in each Category. 'Technology' 'required' for the 'development', 'production' or 'use' of a controlled item remains controlled even when applicable to a non-controlled item. Controls do not apply to that 'technology' which is the minimum necessary for the installation, operation, maintenance (checking) and repair of those items which are not controlled or whose export has been authorised. Controls on 'technology' transfer do not apply to information 'in the public domain', to 'basic scientific research' or to the minimum information necessary for patent applications.

General Software Note (GSN)

The Lists do not control 'software' which is either: 1. Generally available to the public by being: a. Sold from stock at retail selling points, without restriction, by means of: (1) Over-the-counter transactions; (2) Mail order transactions; (3) Electronic transactions; or (4) Telephone call transactions; and b. Designed for installation by the user without further substantial support by the supplier; or 2. 'In the public domain'.

Note 2 to Category 5 Part 2 - Personal Use Exception

Category 5 Part 2 does not control items when accompanying their user for the user's personal use.

Note 3 to Category 5 Part 2 - Cryptography Note (Mass-Market Exception)

Category 5 Part 2 does not control items meeting all of the following: a. Generally available to the public by being sold, without restriction, from stock at retail selling points by means of any of the following: 1. Over-the-counter transactions; 2. Mail order transactions; 3. Electronic transactions; or 4. Telephone call transactions; b. The cryptographic functionality cannot easily be changed by the user; c. Designed for installation by the user without further substantial support by the supplier; and d. When necessary, details of the items are accessible and will be provided, upon request, to the competent authority of the Member State in which the exporter is established in order to ascertain compliance with the conditions described in paragraphs a. to c. above.

Note 4 to Category 5 Part 2 - Ancillary Cryptography Exception

Category 5 Part 2 does not control items where the 'information security' functionality is limited to providing any of the following: a. 'Personalisation' which is limited to what is necessary for the installation in the specific application of the item and which is not available to other users or entities; b. Functionality that is limited to supporting the operation of the items of which it is a component, and is not available to other users or entities.
