Ce chapitre ne comprend pas : les articles a usage technique general (par exemple, les pompes de la position 8413, les garnitures en metal ou graphite de la position 8484), les parties a usage general au sens de la note 2 de la section XV (metaux communs) ou les parties similaires en matieres plastiques (chapitre 39), les pompes elevatoires de la position 8413, ni les appareils de pesage de la position 8423. Note 2 (Parties et accessoires) : les parties et accessoires qui sont des marchandises reprises dans une position de ce chapitre ou des chapitres 84, 85 ou 91 sont classees dans leurs positions respectives. Les autres parties et accessoires exclusivement ou principalement utilises avec les instruments de ce chapitre sont classes a la position 9033. Le chapitre couvre une tres large gamme allant des lentilles et prismes (position 9001) aux microscopes, telescopes, lasers, instruments de navigation, instruments de dessin, instruments de mesure, instruments medicaux, jusqu'aux appareils a rayons X et instruments d'analyse physique ou chimique.
1. La présente Section ne comprend pas : a) les articles pour usages techniques en caoutchouc vulcanisé non durci (n° 4016), en cuir naturel ou reconstitué (n° 4205) ou en matières textiles (n° 5911) ; b) les ceintures et bandages en matières textiles dont l'action sur l'organe à soutenir ou à maintenir résulte uniquement de leur élasticité (par exemple, ceintures de grossesse, bandages thoraciques, bandages abdominaux, bandages pour les articulations ou les muscles) (Section XI) ; c) les produits réfractaires du n° 6903 ; les articles pour usages chimiques ou autres usages techniques en céramique du n° 6909 ; d) les miroirs en verre non travaillés optiquement du n° 7009 ou les miroirs en métaux communs ou en métaux précieux ne constituant pas des éléments d'optique (n° 8306 ou Chapitre 71) ; e) les articles des n°s 7007, 7008, 7011, 7014, 7015 ou 7017 ; f) les parties et fournitures d'emploi général, au sens de la Note 2 de la Section XV, en métaux communs (Section XV) et les articles similaires en matières plastiques (Chapitre 39) ; toutefois, les articles spécialement conçus pour être utilisés exclusivement comme parties d'instruments ou appareils spécifiques sont exclus de cette catégorie ; g) les pompes, compresseurs et ventilateurs (n°s 8413, 8414 ou 8421) ; h) les appareils de pesage (n° 8423) ; les appareils de levage (n°s 8425 à 8428) ; ij) les machines à couper le papier ou le carton (n° 8441) ; les dispositifs pour le réglage des pièces ou des outils sur les machines-outils, du n° 8466 ; k) les articles du Chapitre 95. 2. Sous réserve de la Note 1 ci-dessus, les parties et accessoires des machines, appareils, instruments ou articles de la présente Section sont classés conformément aux règles suivantes : a) les parties et accessoires consistant en articles compris dans l'une des positions de la présente Section ou des Sections XV, XVI ou XVII relèvent de ladite position ; b) les autres parties et accessoires, reconnaissables comme étant exclusivement ou principalement destinés à une machine, un instrument ou un appareil particulier ou à plusieurs machines, instruments ou appareils d'une même position, sont classés avec ces machines, instruments ou appareils ; c) les autres parties et accessoires relèvent du n° 9033.

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, note 3 to Chapter 90 and by the wording of CN codes 9031 , 9031 80 and 9031 80 38 . As the instrument contains both angular velocity sensors and a temperature sensor, it is a composite machine fitted together to form a whole within the meaning of note 3 to Chapter 90 (note 3 to Section XVI). As the temperature sensor is mainly used for providing information for compensating the output signal, the principal function of the instrument is performed by the angular velocity sensors. As the instrument is not used for navigation, classification under heading 9014 as navigational instruments or as parts and accessories thereof is excluded. Although the instrument senses the number of degrees per second, it is not similar to speed indicators of heading 9029 , as the detected values are not indicated on the instrument but transmitted, in the form of an electrical signal, to other apparatus. Classification is determined by general rules 1, 3(b) and 6 for the interpretation of the Combined Nomenclature, note 3 to Chapter 90 and by the wording of CN codes 9031, 9031 80 and 9031 80 38. The heartbeat sensor and the heart rhythm monitoring device are intended to contribute together to a clearly defined function within the meaning of note 3 to Chapter 90 in conjunction with note 4 to Section XVI as the sensor captures the heartbeats and sends the signals to the monitoring device for processing and displaying. The equipment is composite goods made up of components classified under Chapter 90 (measuring or checking device) and Chapter 91 (watch). By virtue of rule 3(b) it is to be classified as if it consisted of the component which gives the equipment its essential character. Given the equipment’s objective characteristics, namely the preponderance of components with the heartbeat measuring and monitoring function, the essential character of the equipment is given by the measuring components. The clock function of the equipment is ancillary to its function as a measuring apparatus since an apparatus for performing measurements based on time (heartbeats per minute) relies on a clock for establishing the time comparison when processing the measurement. Consequently, classification under heading 9102 as a watch is excluded. Classification under heading 9018 as a medical instrument or appliance is also excluded as the apparatus is generally not used in medical professional practice (see also the first paragraph of the Harmonised System Explanatory Notes (HSEN) to heading 9018). Performing a measurement in relation to a time factor (determination of the heart rhythm or heartbeats per minute) is not counting a total number of units of any kind (see also the HSEN to heading 9029, point (A)). Consequently, classification under subheading 9029 10 00 as revolution counters, production counters, taximeters, milometers, pedometers and the like is excluded. The determination of the heart rhythm (heartbeats per minute) is not the determination of the speed of revolution or the linear speed (see also the HSEN to heading 9029, point (B)). Consequently, classification under subheading 9029 20 as speed indicators and tachometers is also excluded. The equipment is therefore to be classified under CN code 9031 80 38 as other electronic measuring or checking instruments, appliances and machines not specified or included elsewhere in Chapter 90.
